Terms of Service
These Terms of Service come into effect on November 1, 2024.
Welcome to Hoya Pay. This Agreement is a contract between you and Hoya Pay regarding your use of Hoya Pay services as a registered user.
Before using Hoya Pay services, you must carefully read and agree to the following terms. If you have not thoroughly read, understood, and agreed to accept and comply with this Agreement, please do not use Hoya Pay services.
By clicking to confirm on the website, or by otherwise expressly or implicitly accepting this Agreement, or by using any part of the Hoya Pay services in any way, you are deemed to have read and agreed to be bound by the terms of this Agreement, related service rules, and the Privacy Policy. Please refer to our Privacy Policy to learn more about how we handle your personal information obtained through the provision of Hoya Pay services. If you are not eligible or do not agree with the relevant policies and rules, you are not authorized to use Hoya Pay services.
1. Definition of Hoya Pay Services
1.1 Wallet: Refers to an electronic payment tool provided by the service provider, which allows users to store, manage, and transfer funds within their accounts.
1.2 Account: Refers to the account registered by the user on the service provider’s platform, used to access wallet services.
1.3 Funds: Refers to virtual currencies, fiat currencies, or other digital assets stored in the user's wallet account.
1.4 Service Provider: Refers to the platform or company that provides the wallet service and is responsible for its operation and management.
1.5 Card: Refers to the virtual or physical cards applied for within Hoya Pay by the user, which are used in designated scenarios.
2. Access to Hoya Pay Services
2.1 You must have the appropriate legal capacity and competence to meet Hoya Pay’s eligibility requirements to access its services. You must be at least 18 years old to use Hoya Pay services.
2.2 Users can use the wallet service to recharge and spend virtual and physical cards.
2.3 Hoya PayWe have the right to modify, suspend or terminate certain service functions as needed, please refer to the platform announcement for details.
3. User Eligibility
3.1 Users must be at least 18 years old and possess full legal capacity for civil conduct in order to register and use this service.
3.2 When registering an account, users must provide true, accurate, and complete personal information.
3.3 Users are responsible for properly safeguarding their account information (such as username, password, card number, etc.) and are fully accountable for all activities conducted within their account.
4. User Account Management
4.1 Users must ensure the security of their account information to prevent unauthorized access, use, or disclosure.
4.2 If a user discovers any security breach or unauthorized transactions in their account, they must immediately notify the service provider and take appropriate measures.
4.3 Hoya PayAccount identity verification can be performed as needed to ensure account security.
5. Deposit and Withdrawal of Funds
5.1 Users can Add funds crypto assets to their wallet accounts through designated channels.
5.2 Users can use the crypto assets in their wallet accounts to make internal transfers. When doing so, they must ensure that there is sufficient balance in their accounts.
When sendUsers should operate according to the corresponding address on the chain and ensure that correct Send information is provided.
5.4 Hoya Pay has the right to charge fees for Add funds such as Send in and out of crypto assets. The specific fee standards are subject to the platform announcement.
6. Risk Disclaimer
6.1 6.1 Users understand and agree that using the wallet service involves certain risks, including but not limited to network risks, payment risks, and potential loss of funds.
6.2 Hoya Pay cannot be held responsible for financial losses caused by improper operation, network failure, third-party risks, etc.
6.3 Users must understand and comply with relevant laws and regulations, ensure that the source of funds in the wallet account is legal, and must not use the service for any unlawful purposes.
7. Hoya Pay's Rights and Obligations
7.1 Hoya Pay has the right to update, upgrade or modify the wallet service according to market demand or operational needs.
7.2 Hoya PayReasonable measures will be taken to ensure the security of user funds and data, but we will not be responsible for losses caused by force majeure, technical failures or user's own operational errors.
7.3 Hoya Pay has the right to suspend or terminate the use of user accounts or take other necessary measures at any time based on user behavior, platform rules or laws and regulations.
8. Rights and Obligations of Users
8.1 Users have the right to check and manage the funds in their wallet account at any time.
8.2 Users are responsible for maintaining the accuracy and completeness of their account information and for updating their information in a timely manner.
8.3 Users shall comply with all platform usage rules and applicable laws and regulations, and shall not use the wallet for any illegal activities.
8.4 Users must ensure the security of their own devices while using the service and shall bear responsibility for any losses caused by device or software issues.
9. Privacy Protection
9.1 Hoya Pay is committed to complying with relevant laws and regulations and protecting users' personal information and privacy.
9.2 The scope and method of Hoya Pay's collection of user information will comply with the Privacy Policy. Please refer to the "Privacy Policy" section for details.
9.3 The user agrees that the service provider may use their personal information when necessary to provide services, improve services, or comply with legal requirements.
10. Term, Termination, and Suspension of Service
10.1 Term. This Agreement becomes effective upon your acceptance or upon your first use of the service and remains in effect until termination under the provisions below.
10.2 Hoya Pay may terminate or suspend the service under the following circumstances: The user provides false, misleading, or inaccurate information or engages in other dishonest conduct; The user is involved in illegal activities, fraud, or terrorist financing; The service cannot be continued due to force majeure events or technical issues; Other situations where the service provider deems it necessary to terminate the service.
10.3 After termination of the service, the user's account will be cancelled and the relevant funds will be handled in accordance with Hoya Pay's policies. You will not be entitled to a refund of the fees paid to Hoya Pay.
10.4 No liability for termination. If either party terminates this Agreement as stipulated, neither party shall be liable for any loss caused by the termination, including lost profits or expected sales. However, termination does not release either party from obligations incurred prior to the effective date of termination.
11. Limitation of Liability and Indemnification
11.1 Unless otherwise provided by law, Hoya Pay is not responsible for losses caused by any technical failure, operational error, force majeure event or third-party behavior.
11.2 Hoya Pay's liability is limited to compensation for direct losses caused by its services within the relevant legal framework, and the amount of compensation shall not exceed the fees paid by the user within a certain period.
(a) Any indirect, incidental, special, or punitive damages and losses;
(b) Any loss of profit, revenue, or business opportunities related to the service.
12. Governing Law and Dispute Resolution
12.1 The interpretation, application, and resolution of disputes under this Agreement shall be governed by the laws of [the jurisdiction of Canada].
12.2 In the event of any dispute arising from this Agreement, both parties shall first attempt to resolve the matter through amicable negotiation. If such negotiation fails, either party may file a lawsuit in the court located in the jurisdiction of the service provider.
13. Miscellaneous
13.1 This Agreement shall become effective from the date the user agrees to and registers to use the wallet service.
13.2 Hoya Pay has the right to modify this Agreement at any time. The modified terms will be posted on the Platform and will take effect immediately.
13.3 If any provision of this Agreement is deemed invalid, the validity of the remaining provisions shall not be affected.
14. Disclaimer
14.1 You understand and agree that Hoya Pay's services are provided in accordance with the current status of what can be achieved with existing technology and conditions. Hoya Pay will do its utmost to ensure the continuity and security of the services, but Hoya Pay cannot guarantee that the services it provides are flawless. Therefore, even if there are defects in the services provided by Hoya Pay, if the above defects are unavoidable due to the technical level of the industry at that time, it will not be regarded as a breach of contract by Hoya Pay, and Hoya Pay does not need to bear any responsibility. Both parties should work together in a friendly manner to solve the problem.
